Mr. Narayan Belbase, Environment Lawyer had made his presentation on an interaction program on The Access Initiative (TAI) on 20 November 2010 for the judiciary community on ” Review and Implementation status of Environmental Justice and Compensatory Provision in Nepal” . He broadly covered the following issues of environmental justice and compensation mechanism under environment protection acts and regulations along with several national and international examples of court cases and environmental justice principles of polluters pay principles etc and their achievements. His paper includes following aspect of the public participation

• Environmental Justice • International and national scenario of environmental justice
• Importance of Environmental Justice and its linkage with Access to Information and Public participation. • Dimension of environmental justice (time, resources, challenges ……) • Existing provision and practices of right to justice related laws and principles. • Compensatory Mechanism and Provision of Environmental damage • Forum available and process for launching compensatory mechanism to realize compensation. • Role of District Administration (CDO, LDO….) , Judiciary system and others for ensuring compensation for environmental damage as well as Access to Justice. • Way forward to ensure right to justice and realization of compensation for environmental damages. • Conclusion and recommendations.
