Justice and Environment, a European Network of Environmental Law Organizations have researched and evaluated to what extent the decision-making practice of the European Commission aligns with the requirements of the Aarhus Convention. The attached study based on desk research of data available at the http://ec.europa.eu/environment/aarhus/internal_review.htm website reveals what chances environmental NGOs have in challenging decisions of European Community institutions made in environmental matters. The assessment presents findings based on EC case law of the legal instrument called Request for Internal Review pursuant to the EU’s Aarhus Regulation.
