HIGH COURT AWARDS COST IN FAVOUR OF FEDEV (PLAINTIFF), IN A PUBLIC INTEREST ENVIRONMENTAL LITIGATION.
The substantive matter in the above case came up before the High Court of Mezam on the 10TH day of August 2009. The 1st Defendant, which is the Bamenda City Council failed to appear in court together with their Counsel. The Judge (Justice Taminang Ignatius) however adjourned the matter at their instance while holding that the 1st Defendant has unnecessarily delayed the case. Consequently, the court ordered the City Council to pay cost of 100.000 FCFA ($ 200) to FEDEV (Plaintiff). The significance of this interim cost does not lie in the amount. Rather we consider it as an encouraging factor to PIL and the course of environmental justice in Cameroon. This venerable order, epitomizes the disposition of our court in fostering environmental justice for the interest of the ordinary citizens and common good.
